Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Muhammed Semri, located at Judeidah-Maker, Israel ("NeuralCore," "we," "us," or "our"). They govern your download, access, subscription to, and use of the NeuralCore mobile application and related services (together, the "Service").
Please read these Terms carefully. By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use NeuralCore
You must be at least 16 and legally capable of agreeing to these Terms. If the law where you live permits someone below the age of legal majority to use the Service, a parent or legal guardian must review and agree to these Terms and supervise that use.
You may not use the Service if doing so is prohibited by applicable law. If you use NeuralCore on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. What NeuralCore provides
NeuralCore is a tinnitus self-management and wellness app that plays masking noise. Depending on your plan and device, features may include white, pink, or brown noise; fixed or microphone-adaptive volume; a user-adjustable notch filter; sleep timers; background audio playback; progress tracking; and optional account-based cloud sync.
Some features are free. Other features require an active NeuralCore Premium subscription. Current features, prices, subscription periods, trial availability, and eligibility are shown in the app and by the App Store or Google Play before purchase.
3. Important health and safety notice
NeuralCore is not a medical device and does not provide medical advice. It is not intended to diagnose, treat, cure, or prevent tinnitus, hearing loss, or any other medical condition. Masking sound may help some people manage how they perceive tinnitus, but results differ and no outcome is guaranteed.
Consult a qualified healthcare professional for medical advice, diagnosis, or treatment. Seek prompt medical care for new, sudden, one-sided, pulsatile, or rapidly worsening tinnitus, or tinnitus accompanied by sudden hearing loss, severe dizziness, neurological symptoms, head injury, or other concerning symptoms. Contact local emergency services if you may be experiencing a medical emergency.
Use NeuralCore at a comfortable volume. Excessive or prolonged sound exposure can damage hearing. The app includes a software volume ceiling, but that ceiling cannot account for every device, headphone, external amplifier, operating-system setting, individual sensitivity, or listening environment and is not a guarantee against hearing injury. Stop using the app and seek professional advice if you experience pain, discomfort, dizziness, increased tinnitus, or a change in hearing.
Do not use masking audio when it could prevent you from hearing alarms, traffic, instructions, another person, or other safety-critical sounds. Do not interact with the app while driving or operating machinery. You are responsible for choosing safe equipment, volume, duration, and surroundings.
4. Microphone access
If you enable adaptive volume, NeuralCore uses the microphone to estimate ambient room loudness while masking audio is playing. Microphone audio is analyzed on your device in real time and is not recorded, stored, or uploaded. You can deny or revoke microphone permission, in which case adaptive volume will be unavailable and the app will use fixed-volume behavior.
The app's handling of information is described in the Privacy Policy.
5. Accounts
An account is optional. The free tier can be used while signed out. An account may be required for cloud sync or other account-based Premium features.
You agree to provide accurate information, keep your credentials confidential, and promptly notify us at support@neuralcore.io if you suspect unauthorized access. You are responsible for activity under your account to the extent permitted by law. You may not transfer, sell, or share an account in a way that compromises security or subscription rules.
You may delete your account through Settings → Delete account. Account deletion is permanent and removes the NeuralCore account and synced app data as described in the Privacy Policy. Deleting an account, signing out, or uninstalling NeuralCore does not cancel an active App Store or Google Play subscription. You must cancel the subscription separately through the store that billed you.
6. Premium subscriptions, trials, billing, and cancellation
Purchase and renewal
Premium subscriptions are sold and billed by Apple through the App Store or by Google through Google Play. The price, currency, billing period, taxes, and material offer terms displayed by the store at confirmation are part of your purchase. Your subscription automatically renews for the period shown at purchase unless you cancel before the renewal deadline specified by the applicable store. The store charges the payment method associated with your store account.
Prices and available plans may change. Any change to an existing subscription will be handled with the notice or consent required by the applicable store and law.
Free trials and promotions
If a free trial or promotional offer is shown to you, its duration and eligibility rules will be displayed before confirmation. Unless you cancel before the deadline shown by the store, the trial converts to a paid auto-renewing subscription and the store charges the displayed price. Trial eligibility is determined by Apple or Google and may be limited to new or qualifying subscribers.
Cancellation
You can manage or cancel through your Apple subscriptions or Google Play subscriptions settings. Cancellation normally takes effect at the end of the current paid period unless the store or applicable law provides otherwise. You generally retain Premium access until then.
Deleting your NeuralCore account, deleting the app, or stopping use does not cancel billing. If you delete your account while a subscription remains active, you may need to restore purchases or create/sign in to an eligible account to use account-based features.
Refunds
Apple or Google processes payments and refund requests under its rules and applicable law. Except where required by law or expressly stated by the applicable store, charges are non-refundable and no credits are provided for a partially used billing period. Nothing in these Terms limits any mandatory cancellation, withdrawal, refund, or consumer rights you have under applicable law.
7. License and ownership
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use NeuralCore on devices you own or control for your personal, non-commercial use, as permitted by the applicable app-store usage rules.
NeuralCore and its software, design, graphics, branding, audio generation, text, and other content are owned by us or our licensors and are protected by intellectual-property and other laws. Except for the limited license above, no rights are transferred to you.
You may not:
- copy, sell, rent, sublicense, distribute, or commercially exploit the Service except where law expressly permits;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except to the limited extent such a restriction is prohibited by law;
- bypass, disable, or interfere with subscription checks, safety limits, security controls, or access restrictions;
- use the Service to violate law, infringe rights, introduce malicious code, disrupt systems, or gain unauthorized access; or
- misrepresent affiliation with NeuralCore or use our names, logos, or branding without permission.
Open-source components included in the app remain subject to their applicable licenses.
8. Third-party services and terms
NeuralCore relies on third-party services, including Apple, Google Firebase, Google Sign-In, and RevenueCat. Your use of those services and your device may also be subject to their terms and privacy policies. You agree to comply with applicable third-party terms, including the App Store or Google Play rules that apply to your device and purchases.
We are not responsible for third-party services or for outages, account actions, payment decisions, or changes controlled by those providers, except to the extent applicable law makes us responsible.
9. Feedback
If you send ideas or feedback about NeuralCore, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate that feedback without restriction or compensation. This does not transfer ownership of personal information included in a support request, which remains governed by the Privacy Policy.
10. Changes, updates, and availability
We may add, change, suspend, or discontinue features, provided that we will honor mandatory consumer rights and applicable subscription obligations. We may release updates that are needed for security, compatibility, legal compliance, or continued operation. Some features may stop working if you do not install required updates.
The Service may occasionally be unavailable because of maintenance, network conditions, third-party failures, emergencies, or events beyond our reasonable control. We do not promise that cloud sync will be continuous, error-free, or a backup service. Keep any information you need independently.
11. Suspension and termination
You may stop using NeuralCore at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create security or legal risk, misuse the Service, or if we are required to do so by law or an app-store provider. Where reasonable and legally required, we will give notice and an opportunity to remedy the issue.
Termination does not automatically cancel a store subscription. Sections that by their nature should survive termination — including ownership, disclaimers, limits of liability, disputes, and store-specific terms — will survive.
12. Disclaimers
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all express, implied, and statutory warranties, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and any warranty arising from course of dealing or usage of trade. We do not warrant that NeuralCore will meet your health needs, reduce tinnitus, be uninterrupted or error-free, preserve all data, or work with every device, accessory, operating system, or third-party service.
13. Limitation of liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, or any liability that cannot be excluded or limited by law.
To the maximum extent permitted by law, NeuralCore and its operator, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or use, arising from or related to the Service, even if advised that such damages were possible.
To the maximum extent permitted by law, the total aggregate liability of NeuralCore and its operator arising from or related to the Service will not exceed the greater of (a) the amount you paid for NeuralCore during the 12 months before the event giving rise to the claim or (b) US $100 or its equivalent in local currency.
The exclusions and limits above apply only to the extent permitted where you live. Some jurisdictions do not allow certain exclusions or limits, so some of them may not apply to you.
14. Governing law and disputes
These Terms are governed by the laws of Israel, without regard to conflict-of-laws rules. Subject to any mandatory right you have to bring a claim elsewhere, the courts of Tel Aviv, Israel will have exclusive jurisdiction.
If you are a consumer, this section does not deprive you of protections or court access provided by mandatory law where you live. Before filing a claim, please contact support@neuralcore.io so we can try to resolve the issue informally. This does not shorten or pause any legal limitation period unless applicable law provides otherwise.
15. General terms
These Terms and the Privacy Policy form the entire agreement between you and us concerning the Service, except for purchase terms presented by the applicable app store. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or transfer of the Service, subject to applicable law. Headings are for convenience only.
We may update these Terms to reflect changes to the Service, law, or business. We will update the "Last updated" date and, where required, give advance or in-app notice. If a material change requires consent, we will request it. Continued use after an effective update constitutes acceptance only where permitted by law.
16. Additional terms for Apple users
If you downloaded NeuralCore from Apple's App Store, you and we acknowledge and agree that:
- these Terms are between you and Muhammed Semri, not Apple, and we — not Apple — are responsible for NeuralCore and its content;
- your license is limited to a non-transferable right to use NeuralCore on Apple-branded products you own or control as permitted by the Apple Media Services usage rules, including applicable Family Sharing or volume-purchase rules;
- Apple has no obligation to provide maintenance or support for NeuralCore;
- if NeuralCore fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as required by Apple's terms; to the maximum extent permitted by law, Apple has no other warranty obligation;
- we, not Apple, are responsible for addressing claims relating to NeuralCore, including product-liability, legal-compliance, consumer-protection, privacy, and intellectual-property claims;
- you represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and you are not listed on a United States Government prohibited- or restricted-party list;
- you must comply with applicable third-party terms when using NeuralCore; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
